Dr. Arnd Wiebusch advises companies and their owners on the structuring, formation, reorganization & restructuring, transactions and dissolution of companies. He also covers inheritance law issues in terms of corporate succession. In addition, Dr. Wiebusch advises companies and private investors on real estate law, in particular on real estate transactions. A further focus of his work is the assertion and defense of directors’ liability claims both internally and in relation to third parties (so-called external liability), where tortious claims, in particular in connection with criminal offenses, are in the foreground. Potential claimants include social security institutions, the tax office, the insolvency administrator and often also the company’s principal bank due to collateral (guarantees, land charges, mortgages, etc.) personally granted by the managing director or his relatives. Due to his background, Dr. Wiebusch is very familiar with the perspective of the insolvency administrator and the D&O insurer.
