Product liability
Manufacturers and importers of products not only have legal relationships with their direct customers. Rather, the manufacturer and importer also have obligations and liability risks towards consumers with regard to the products placed on the market.
The economic significance of product liability obligations and risks is usually extremely high. On the other hand, the costs of product liability measures, in particular the costs of product recalls, can also reach considerable dimensions. At the same time, every product liability measure (and the failure to take such measures) is associated with a risk to the reputation of the manufacturer or importer, as is the risk of recourse by resellers.
Product liability law issues therefore require a particularly careful examination of the legal framework, which is often overlaid by European standards.
